The Federation is pretty loose about the term Flagship.

Other ships at times have been Flagships. We don't know if Enterprise-C was the flagship of that time, and if so, then it likely transferred to another ship.

Riker having to be the prosecution was a bit forced, but the emotions of the moment where he turned Data off, was visceral.
